End-user license agreement

Last updated: 2026-11-04. Version 2.0.

This End-User License Agreement (the “Agreement”) is a legal agreement between you and WiderUp LLC, a Minnesota limited liability company, 2909 S Wayzata Boulevard #1019, Minneapolis, MN 55405, United States (“WiderUp”, “we”, “us”), for Spiroshader™.

Please read Section 9 (Health and safety) before using the Software. The Software produces rapid flashes that can trigger seizures in people with photosensitive epilepsy.

You accept this Agreement by selecting an acceptance control when it is presented to you, or by otherwise affirmatively accepting it through the store or platform through which you obtained the Software. If you do not accept it, do not install or use the Software. WiderUp will make this Agreement available before acceptance and in a form you can save. Nothing in this Agreement limits a mandatory cancellation or refund right if you decline it.

If you use the Software on behalf of a company or another organization, “you” means that organization. You confirm that you have the authority to bind it, and the organization is responsible for everyone who uses the Software under its licenses.

1. Definitions

In this Agreement:

2. License grant

2.1 Base license

Subject to this Agreement and to your Entitlement, WiderUp grants you a non-exclusive, non-transferable, revocable (only as described in Section 14) license to install and use the Software for your own purposes, whether private, professional or commercial. For a paid, non-time-limited purchase, this license has no fixed expiration date, subject to Section 14.

The license is non-transferable except where applicable law gives you a right to transfer it despite that restriction or where the Store expressly permits a transfer.

2.2 Copies, devices and accounts

2.3 Professional, commercial and public use

You may use the Software and its Output for professional or commercial purposes, including events, venues, installations, retail and hospitality spaces, production work, live performances, streams, broadcasts and recordings, and you may use the Output as part of a service you provide to others. You may show the Output publicly and record, stream and distribute it. No additional license fee or royalty is payable to WiderUp solely for those uses of the Output. This permission includes operating the Software yourself, or through personnel acting under your control, to provide services to clients.

WiderUp claims no rights in the Output merely because it was produced using the Software. Presets, images, video, music and other material used in the Output may be subject to third-party rights. This Agreement does not grant you rights in third-party material that you do not otherwise have, including public performance rights in music.

This permission concerns the Output. Making the Software itself available to customers or other third parties is restricted by Section 4.

2.4 Networked and remote use

3. Scope of the license

The limits of the Software described in its documentation (for example the number of Followers, instances, mixer tracks, effects and sprites) and disclosed before purchase are part of the scope of the license, not defects merely because they are limits. This does not excuse a failure to meet the agreed description, functionality, compatibility, security, or other mandatory conformity requirements. The Apple TV edition is made to be used as a Follower of a licensed desktop Leader. Features advertised as included in the base edition when you purchase it will not later require a separately purchased add-on for continued use under your existing license. New, separately offered functionality may require a separate purchase.

4. Restrictions

Except as expressly permitted by this Agreement or by applicable law that cannot validly be excluded or restricted, you may not do the following:

Nothing in this Agreement restricts rights that applicable law gives you and does not permit WiderUp to exclude or restrict by contract. Good-faith security research that meets the safe-harbor conditions on the Security and vulnerability reporting page of the user guide supplied with your version is permitted despite the restrictions above. Later changes to those conditions do not retroactively withdraw permission for research already conducted in accordance with them.

5. Ownership and third-party components

5.1 Ownership

The Software is licensed, not sold. Except for components and content governed by separate licenses, WiderUp and its licensors retain all rights, title and interest in the Software, including its proprietary code, design, artwork and documentation and all related intellectual property rights. All rights not expressly granted are reserved.

5.2 Open-source and third-party components

The Software contains open-source and other third-party components. Their licenses and notices are provided under “Licenses and third-party notices” in the user guide and in the files installed with the Software. Those licenses govern the components to which they apply. Where such a license gives you broader rights in a component than this Agreement does, that license controls for that component. Nothing in this Agreement restricts rights granted directly to you under such a license.

5.3 Microsoft components

The Windows edition includes the Microsoft DirectX Shader Compiler (dxcompiler.dll), which Microsoft Corporation licenses to WiderUp for distribution with the Software. The Microsoft Software License Terms for this file are reproduced under “Licenses and third-party notices”. In addition to the rest of this Agreement, the following applies to this file:

6. Presets, Output and your content

6.1 Your content

As between you and WiderUp, WiderUp claims no ownership of Presets, playlists, images, screenshots, recordings, configurations or other material that you create with or for the Software. You retain whatever rights you have in that material, and WiderUp receives no copy of it merely because you create, open or use it with the Software. Presets and other content you create, including any shader or expression code they contain, are not derivative works of the Proprietary Software for purposes of Section 4.

6.2 WiderUp’s presets

The Presets WiderUp ships with the Software or publishes on its website are released under the CC0-1.0 public-domain dedication or, at your option, the Zero-Clause BSD license (0BSD), unless a different license is stated with them. Any different license will be identified with the relevant Preset before acquisition. A later change to the license for a new Preset or version does not revoke rights already granted in an earlier version.

6.3 Third-party content

Presets, packages and other content obtained from third parties are provided by their authors or rights holders and are governed by the licenses or permissions those persons provide. The fact that the Software can load third-party content does not mean that WiderUp owns, licenses, endorses or has verified it. You are responsible for determining whether your intended use, including public, commercial or broadcast use, is permitted.

Third-party content may contain errors, cause crashes or excessive resource use, or produce visual effects with stronger flashing than WiderUp’s own Presets. To the fullest extent permitted by applicable law, you use third-party content at your own risk. This does not exclude WiderUp’s responsibility for content it supplies or for defects in the Software to the extent that responsibility cannot lawfully be excluded.

When you use content on more than one device, you are responsible for having the right to install it on each of them.

6.4 Cameras, shared video and people

You are responsible for complying with applicable privacy, image, publicity, recording and venue rules and for obtaining any notice, consent or permission required when you capture, display, stream or record other people or third-party material.

6.5 Feedback

If you send WiderUp suggestions or other feedback about the Software, WiderUp may use it without obligation to you. This does not give WiderUp rights in your Presets or other content beyond what you expressly license.

7. Updates, Early Access and availability

7.1 Early Access

The Software may be offered as an “Early Access” product while it is still in development, and you may choose to install pre-release (“beta”) builds that the Store offers. During Early Access and in pre-release builds, features, limits, performance, file formats and user interface may change, and the Software may contain errors. The Store’s description at the time of your purchase states what the Software includes. WiderUp intends to continue development but does not promise a release date for any feature that is not included at the time of purchase. Early Access and beta labels do not waive mandatory conformity, update, or remedy rights. Where consumer law permits a departure from otherwise required objective conformity standards only after specific disclosure and separate express acceptance, a general acceptance of this Agreement does not constitute that separate acceptance.

7.2 Updates

WiderUp may provide updates that fix, add, change or remove features. Updates are licensed under this Agreement or under terms presented with them and accepted as required by Section 16. Where applicable law requires WiderUp to provide updates, including security updates, for a period, WiderUp will do so for that period and inform you of their availability and the consequences of failing to install them. That period includes the period a consumer may reasonably expect for a one-time supply, considering the nature, purpose, price, and representations about the Software, and the required period for any continuous supply. WiderUp will not use updates to remove a feature that is a main characteristic of the Software you obtained, except where applicable law permits it (for example for security, legal compliance, or changes made by a Store or third-party device maker that WiderUp cannot control). For consumers in the EEA, any modification beyond what is necessary to maintain conformity will be made only where the contract permits it for a valid reason, without additional cost, and with clear information. Valid reasons are addressing security risks, complying with legal requirements, maintaining compatibility with supported third-party systems, and improving functionality or performance. If such a modification negatively affects access or use more than only to a minor extent, WiderUp will give reasonable advance notice on a durable medium of its features, timing, and your right to terminate free of charge within 30 days after the later of that notice or the modification. This termination right does not apply where WiderUp enables you to retain, without additional cost, an unmodified version that remains in conformity. Termination includes any reimbursement required by mandatory consumer law. These provisions do not authorize a modification prohibited by Section 3 or reduce stronger mandatory rights.

7.3 Third-party services and devices

Some features depend on third-party systems that WiderUp does not control, such as Store services, operating-system audio and video interfaces, graphics drivers, and Connected Devices and their firmware. If a third party changes or discontinues such a system, a feature that depends on it may stop working. To the extent permitted by applicable law, WiderUp is not responsible for such changes but will make reasonable efforts to keep supported integrations working. This does not excuse mandatory conformity or update duties or the remedies available if a promised supported integration fails.

7.4 Discontinuation

Nothing in this Agreement obliges WiderUp to continue distributing the Software or to provide new features or support indefinitely, except where applicable law requires otherwise. Discontinuation of sale, distribution, development, updates or support does not by itself terminate a license previously granted to you.

8. Privacy

What the Software does and does not do with personal data, including the data exchanged with Connected Devices, is described in the Spiroshader Privacy Policy, available in the Software’s Help tab and at https://spiroshader.com/legal/app-privacy. The Privacy Policy is a notice and not part of this Agreement.

9. Health and safety

9.1 Photosensitive seizure warning

WARNING — Photosensitive seizure warning: This visualizer produces strong contrast, rapid flashes, and flickering patterns synchronized to audio. Certain combinations of light, color and flashing can have adverse effects on your health. A very small percentage of people may experience seizures, blackouts, or other symptoms when exposed to such visual stimuli, even with no prior history of epilepsy. Stop using the visualizer immediately if you feel any discomfort, and consult a doctor if you experience dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, or any involuntary movement or convulsion. Use in a well-lit room and sit a comfortable distance from the screen.

The Software shows this warning when it is first started and asks you to confirm it before continuing. It can be read again at any time from the Help tab.

9.2 Public display

If you show the Output to other people, including at events, in venues, in retail or hospitality spaces or on large screens, you are responsible for warning them about flashing light in the way required or customary where you show it, and for complying with local venue, safety and accessibility rules. Provide a conspicuous warning before exposure, assess the suitability of the content and display settings for the audience and location, and stop the display promptly if anyone appears adversely affected. Audience warnings do not make every display safe. Nothing in this section transfers or excludes WiderUp’s own product-safety or product-liability obligations.

10. Warranty

To the fullest extent permitted by law, the Software is provided “as is” and “as available”, without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment and non-infringement.

WiderUp does not warrant that the Software will be uninterrupted or error-free, that it will work with every operating system, graphics device, graphics driver, audio device, camera, network, Connected Device, firmware version or third-party software, or that it will produce any particular visual result.

Nothing in this section limits rights you have as a consumer under applicable law, including rights concerning conformity, quality, description, performance, updates, repair, replacement, price reduction, refund or other remedies. In jurisdictions with mandatory digital-content protections, those protections remain unaffected. In particular, the disclaimers do not override the agreed product description or mandatory rights of consumers in the EEA, United Kingdom, Australia, or New Zealand.

Refunds of purchases made through a Store are administered by that Store under its terms, without limiting additional rights you have under mandatory law. A Store’s discretionary refund deadline does not shorten a statutory claim period or make the Store your exclusive recourse against WiderUp. You may contact support@spiroshader.com for assistance with a statutory remedy.

11. Support

WiderUp provides support by email as described on its website. Support is provided for the Software in the configurations described in the documentation. WiderUp may decline support for configurations controlled by third-party software, for modified or third-party content, and for Connected Devices not listed in the documentation. Nothing in this section limits your rights under Section 10.

12. Limitation of liability

The exclusions and cap below are subject to all exceptions in this section. To the fullest extent permitted by law, WiderUp and its suppliers and licensors will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of data, profits, revenue, goodwill or business, arising out of or related to the Software or this Agreement, however caused and on any theory of liability, even if advised of the possibility of such damages. For consumers, these exclusions apply only to losses that were not reasonably foreseeable when the contract was made, and to business losses arising from non-business use; they do not exclude reasonably foreseeable loss caused by WiderUp’s breach.

To the fullest extent permitted by law, WiderUp’s total liability arising out of or related to the Software or this Agreement will not exceed the greater of the amount you paid for the Software or USD 50. This cap does not apply to consumer claims for reasonably foreseeable loss caused by WiderUp’s breach or to the exceptions below.

These limitations do not apply to liability that applicable law does not permit WiderUp to limit or exclude, including, where applicable, liability for death or personal injury caused by negligence, for fraud, for gross negligence or willful misconduct, or for breach of an essential contractual obligation to the extent applicable law requires liability for the foreseeable, typical damage. For users in Germany, liability for intent, gross negligence, negligent injury to life, body or health, fraudulent concealment, an expressly assumed guarantee, and mandatory product liability is not excluded or capped. For simple negligence in breach of an essential contractual obligation, liability is limited to foreseeable damage typical of the contract, without the monetary cap or categorical exclusions above. Essential contractual obligations are obligations whose performance is necessary to achieve the contract’s purpose and on whose performance you may ordinarily rely.

Nothing in this section limits or excludes any repair, replacement, refund, price reduction, compensation or other remedy that applicable consumer law does not permit WiderUp to limit or exclude, or liability under mandatory product-liability law, including national law implementing Directive (EU) 2024/2853 where that regime applies. This includes non-excludable compensation for damage to a device or other digital content caused by defective digital content. The protections in this section also apply to claims against suppliers and licensors to the extent this Agreement purports to limit those claims.

13. Indemnity

If you use the Software for a business, you will defend and indemnify WiderUp against third-party claims to the extent caused by your unlawful public display of the Output, your infringement of third-party rights in content you supply, or your material breach of Section 6.4, except to the extent the claim results from WiderUp’s own breach of this Agreement or its negligence or other fault, or a defect in the Software. This section does not apply to consumers. It covers reasonable defense costs and damages finally awarded or agreed in a settlement you approve, with approval not unreasonably withheld. WiderUp will notify you promptly of a claim, allow you to control its defense with competent counsel, and provide reasonable cooperation at your expense. Delay in notice reduces your obligation only to the extent it materially prejudices the defense. You may not settle a claim by admitting fault on WiderUp’s behalf, imposing a non-monetary obligation on WiderUp, or failing to release WiderUp fully, without WiderUp’s prior written consent. WiderUp may participate with its own counsel at its own expense.

14. Term and termination

This Agreement takes effect when you accept it and remains in effect until it is terminated under this section. You may terminate it at any time by uninstalling the Software and deleting all copies in your possession or control.

WiderUp may terminate your license if you materially breach this Agreement and, after notice identifying the breach and the steps needed to cure it, you fail to cure within 30 days after receipt. WiderUp may terminate immediately for a material breach that cannot be cured or where immediate termination is necessary to prevent serious harm or unlawful activity, subject to mandatory consumer protections. Termination will be proportionate to the breach and will not apply retroactively to authorized use.

If your license terminates because of your breach, you must stop using the Proprietary Software and delete copies in your possession or control, except where applicable law permits otherwise.

Termination does not affect rights granted directly to you under an open-source or third-party license, rights you have in your own content, or rights that applicable law does not permit WiderUp to terminate. Termination does not revoke your right to use or distribute Output lawfully created before termination or separately licensed Presets. It does not affect accrued claims or statutory reimbursement rights.

Sections 1, 4 (as far as it concerns conduct before termination), 5, 6, 9.2, 10, 12, 13, 14, 15 and 16 survive termination, together with any other provision that by its nature is intended to survive.

15. Store-specific terms

15.1 Steam

If you obtained the Software through Steam, the Steam Subscriber Agreement and other applicable Steam terms also apply. Where they conflict with this Agreement about your Steam account, purchases, refunds, Entitlements, family sharing or the Steam platform, the Steam terms prevail.

15.2 Apple App Store

This section applies if you obtained the Software through the Apple App Store (including the Apple TV edition). Where it conflicts with another provision of this Agreement, this section prevails for Software obtained that way.

15.3 Google Play

If you obtained the Software through Google Play, you receive the nonexclusive, worldwide license required by the applicable Google Play distribution terms. For a paid purchase that is not expressly time-limited, the license is perpetual, subject only to lawful termination under Section 14 and any stronger rights required by those distribution terms. Google Play’s mandatory usage and license rules prevail over a conflicting restriction in this Agreement.

16. General
